“INDIA AS A HUB FOR INTERNATIONAL ARBITRATION: OPPORTUNITIES, CHALLENGES AND ROAD AHEAD”

Abstract

This research paper examines India’s evolving role as an international arbitration hub, focusing on its opportunities, challenges, and future prospects. The study’s primary objectives are to analyze the impact of recent legal reforms and institutional developments, identify competitive advantages, explore existing barriers, and propose actionable solutions to strengthen India’s arbitration ecosystem. Employing a doctrinal qualitative methodology, the paper reviews statutory amendments—including the Arbitration and Conciliation (Amendment) Bill 2024—government policies, judicial trends, and empirical data from established arbitration centers like the Mumbai Centre for International Arbitration (MCIA) and the India International Arbitration Centre (IIAC). Key findings reveal that while India has made substantial progress in establishing a pro-arbitration legal framework and modern institutional structures, challenges persist due to judicial intervention, infrastructural deficits, and reluctance among public sector entities to fully embrace arbitration. The significance of the study lies in providing policymakers, legal practitioners, and businesses with comprehensive insights to facilitate strategic reforms, boost confidence in arbitration as a dispute resolution mechanism, and position India competitively on the global arbitration map. With sustained reform momentum, infrastructure investment, and international collaboration, India is poised to become a leading global venue for efficient and credible dispute resolution.
