Abstract

The judiciary plays an essential role in ensuring the effective implementation of consumer protection laws in Gujarat, safeguarding the rights and interests of consumers in an increasingly complex market environment. This research paper provides a comprehensive analysis of how the judicial system, particularly the Consumer Disputes Redressal Commissions and the Gujarat High Court, interprets and enforces the Consumer Protection Act, 2019 within the state. The study explores the structural setup of consumer forums, key judicial interventions, types of consumer grievances, and how courts have responded to emerging challenges in sectors like real estate, healthcare, e-commerce, and financial services. Emphasis is laid on the evolving nature of judicial reasoning in consumer matters, the use of technology in court proceedings, and the growing significance of judicial activism in expanding the scope of consumer rights. The paper also highlights critical challenges such as pendency of cases, lack of awareness among consumers, and infrastructure limitations, and suggests ways to strengthen the consumer judicial system. Through this analytical approach, the paper aims to underscore the judiciary’s indispensable function in protecting consumer welfare and promoting accountability, transparency, and fairness in Gujarat’s marketplace.
