THE LEGAL LANDSCAPE OF SOLID WASTE MANAGEMENT IN INDIA: CHALLENGES AND PROSPECTS

Solid Waste Management (SWM) is a critical environmental and public health issue in India, driven by rapid urbanization, population growth, and industrialization. The legal framework governing SWM in India comprises constitutional provisions, central and state legislations, regulatory guidelines, and judicial interventions. Despite the existence of key legislations such as the Solid Waste Management Rules, 2016, Environment Protection Act, 1986, and Municipal Solid Wastes (Management and Handling) Rules, 2000, challenges persist in enforcement, infrastructure development, financial sustainability, and public participation. Weak regulatory compliance, inadequate waste segregation, inefficient landfill management, and lack of integration of the informal waste sector further exacerbate the issue. This study critically examines the legal landscape of SWM in India, identifying key obstacles in implementation and exploring prospects for strengthening the regulatory framework. The paper highlights the need for stronger enforcement mechanisms, decentralized waste processing infrastructure, enhanced public-private partnerships (PPPs), and financial incentives for sustainable waste management solutions. Additionally, it advocates for greater public awareness, technology-driven waste monitoring, and the inclusion of informal waste pickers in formal waste collection systems. By adopting a circular economy approach, integrating smart waste management solutions, and ensuring stricter regulatory oversight, India can overcome existing challenges and transition toward a more sustainable and legally robust waste management system. This study provides policy recommendations to enhance the effectiveness of SWM laws, ensuring better environmental and health outcomes for the country.
